Scott Konopka obtained a final summary judgment from Judge Lawrence Mirman, circuit court judge of the 19th judicial circuit, in a marina dock dispute regarding the existence and scope of riparian rights in a subdivision on the St. Lucie River, in Martin County , Florida. Judge Mirman ruled that as a matter of law, our clients owned the riparian rights appurtenant to their waterfront property. The dock owners association argued that the clients’ predecessors in title had conveyed away the riparian rights to the original developer, and as a result that all owners in the association had a 1/40th interest in the riparian rights. The case involved parallel efforts by the association to obtain administrative permits to build a community marina.
